Signatory Terms & Conditions

The MySign Electronic Signature Platform is operated by TrustLink Digital Limited.

TrustLink Digital is a TPP under UK eIDAS regulation.

  1. Introduction

These Signatory Terms and Conditions govern your use of the MySign electronic signature service to sign documents.

By proceeding to sign a document through MySign, you agree to be bound by these Terms.

MySign is operated by TrustLink Digital Limited, a company registered in England and Wales.

We provide an electronic signature platform that enables you to sign documents electronically in compliance with UK and EU electronic signature regulations.

If you do not agree to these Terms, you must not proceed with signing any document through MySign.

  1. Definitions

In these Terms:

"AML" means Anti-Money Laundering checks and procedures;

"Device Fingerprint" means technical information collected about the device you use to sign documents;

"eIDAS" means Regulation (EU) No 910/2014 on electronic identification and trust services, as retained in UK law;

"Electronic Signature" means data in electronic form which is attached to or logically associated with other data in electronic form and which is used by you to sign;

"KBA" means Knowledge-Based Authentication;

"KYC" means Know Your Customer identity verification procedures;

"PEP" means Politically Exposed Person;

"QTSP" means Qualified Trust Service Provider as defined under eIDAS;

"Service" or "MySign" means the electronic signature platform;

"Verification Checks" means the identity verification procedures described in Clause 5;

"We", "Us", "Our" means TrustLink Digital Limited;

"You", "Your" means you, the person signing a document through MySign.

  1. The Electronic Signature Service

Service Description

MySign enables you to sign documents electronically. We are not a QTSP but we utilise services from QTSPs to provide certain aspects of the Service where required for compliance with eIDAS and UK regulations.

No Charge to Signatories

There is no charge to you for using MySign to sign documents. The party requesting your signature bears the cost of the Service.

Document Sender Responsibility

The person or organisation that sent you the document for signature is responsible for the content of that document. We do not review, verify, or take responsibility for the content of documents you are asked to sign.

  1. Legal Effect of Electronic Signatures

Binding Effect

By applying your electronic signature through MySign, you expressly consent to be legally bound by the document you are signing. Your electronic signature has the same legal effect as your handwritten signature.

Compliance with Law

Electronic signatures created through MySign are intended to comply with eIDAS and the Electronic Communications Act 2000 (as amended). The legal admissibility and enforceability of electronic signatures may vary depending on the nature of the document and applicable law.

Your Responsibility

You are responsible for:

  • Reading and understanding any document before you sign it;

  • Ensuring you have authority to sign the document;

  • Seeking independent legal advice if you are unsure about the content or effect of any document; and

  • Retaining copies of documents you sign for your own records.

Audit Trail

MySign creates and maintains a comprehensive audit trail for each signature, including timestamps, IP addresses, device information, and verification data. This audit trail forms part of the evidentiary record of your signature.

  1. Identity Verification

Why We Verify Your Identity

To ensure the integrity and security of the electronic signature process and to comply with legal and regulatory requirements, we must verify that you are who you claim to be before allowing you to sign a document.

Verification Checks Performed

At the point of signing, we may perform some or all of the following checks:

  • Anti-Money Laundering (AML) checks - screening against financial crime databases;

  • Know Your Customer (KYC) verification - confirming your identity against official records;

  • Politically Exposed Person (PEP) screening - identifying individuals with prominent public functions;

  • Sanctions screening - checking against international sanctions lists;

  • Location verification - determining your geographic location at the time of signing;

  • Device Fingerprinting - collecting technical information about your device;

  • IP Address logging - recording the network address you are signing from;

  • Soft Credit Check - verifying your identity against credit reference agency records; and

  • Knowledge-Based Authentication (KBA) - asking you questions based on your credit history to verify your identity.

Your Consent

By proceeding to sign a document through MySign, you expressly consent to these Verification Checks being performed.

These checks are necessary for the proper and secure functioning of the Service.

Accuracy of Information

You must provide accurate, complete, and truthful information for identity verification.

Providing false or misleading information may constitute a criminal offence and will result in your signature being rejected.

Credit Checks

When we perform a soft credit check:

  • The check will NOT affect your credit score or credit rating;

  • The check will be recorded on your credit file but will only be visible to you;

  • Lenders and other credit providers will not see this check;

  • We use credit reference agencies solely to verify your identity, not to assess your creditworthiness.

Failed Verification

If you fail the Verification Checks, we will be unable to process your signature.

This may occur for various reasons, including:

  • Inability to verify your identity;

  • Matches against sanctions or watchlists;

  • Suspicious or fraudulent activity indicators;

  • Technical or system issues; or

  • Legal or regulatory requirements that prevent us from processing your signature.

Third-Party Providers

We use reputable third-party service providers to perform Verification Checks.

These providers are bound by strict data protection and confidentiality obligations.

  1. Data Protection and Privacy

How We Use Your Data

We collect and process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Data We Collect

When you sign a document through MySign, we collect:

  • Your name, email address, and contact details;

  • Identity verification data from the checks described in Clause 5;

  • Device and technical information (IP address, device fingerprint, browser details);

  • Location data;

  • Timestamp and signature data; and

  • The documents you sign (stored on behalf of the document sender).

Purpose of Processing

We process your personal data for the following purposes:

  • To provide the electronic signature service;

  • To verify your identity and prevent fraud;

  • To comply with legal and regulatory obligations;

  • To maintain audit trails for evidentiary purposes;

  • To improve our services; and

  • To protect the security and integrity of the Service.

Legal Basis

We process your personal data on the basis of:

  • Your consent (which you give by proceeding to sign);

  • Performance of a contract (facilitating your signature);

  • Legal obligations (compliance with financial crime and data retention regulations); and

  • Legitimate interests (fraud prevention and service security).

Data Retention

We retain your signature data and audit trail information for a minimum of six years following the date of signature, or longer if required by law or to comply with legal proceedings.

After this period, data will be securely deleted unless there is a legal obligation to retain it.

Your Rights

Under data protection law, you have the right to:

  • Access your personal data;

  • Rectify inaccurate personal data;

  • Request erasure of your personal data (subject to legal and regulatory retention requirements);

  • Restrict processing in certain circumstances;

  • Data portability;

  • Object to processing based on legitimate interests; and

  • Lodge a complaint with the Information Commissioner's Office (ICO).

Sharing Your Data

We may share your data with:

  • The person or organisation that requested your signature;

  • QTSPs and verification service providers;

  • Credit reference agencies (for identity verification only);

  • Law enforcement and regulatory authorities where required by law; and

  • Professional advisers (lawyers, auditors) where necessary.

International Transfers

Some of our service providers may be located outside the United Kingdom.

Where we transfer your data internationally, we ensure appropriate safeguards are in place as required by data protection law.

  1. Your Responsibilities

Document Review

You must carefully read and understand any document before signing it.

We strongly recommend that you:

  • Read the entire document;

  • Understand the terms and your obligations;

  • Download and save a copy for your records; and

  • Seek independent legal or professional advice if you have any doubts.

Authority to Sign

You represent and warrant that you have the legal capacity and authority to sign any document to which you apply your electronic signature.

If you are signing on behalf of an organisation, you confirm that you have proper authority to bind that organisation.

Accurate Information

You must provide accurate and truthful information at all times.

Providing false information may invalidate your signature and may constitute a criminal offence.

Security

If you receive a link to sign a document:

  • Do not share the link with anyone else;

  • Ensure you are the person intended to sign the document; and

  • Complete the signing process promptly as links may expire.

Prohibited Uses

You must not:

  • Use MySign for any unlawful purpose;

  • Attempt to impersonate another person;

  • Interfere with or disrupt the Service;

  • Attempt to gain unauthorised access to the Service or related systems; or

  • Use the Service in any way that violates applicable law.

  1. Service Limitations

Provided 'As Is'

The Service is provided on an 'as is' and 'as available' basis.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

No Legal Advice

We do not provide legal advice.

We do not review or assess the legal validity, enforceability, or appropriateness of any document you are asked to sign.

You should seek independent legal advice if you have any concerns.

Third-Party Services

The Service relies on third-party services including QTSPs, verification providers, and credit reference agencies.

We are not responsible for any failures, errors, or delays caused by these third parties.

Technical Requirements

You must have appropriate hardware, software, and internet connectivity to use the Service.

We are not responsible if you are unable to access the Service due to technical limitations on your end.

Service Availability

We may suspend or withdraw the Service at any time for maintenance, updates, security reasons, or any other reason.

We will endeavour to provide advance notice where reasonably practicable.

  1. Liability

Document Content

We are not responsible for the content, accuracy, legality, or enforceability of documents you sign through MySign.

Your contractual relationship is with the party who sent you the document, not with us.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, consequential, incidental, special, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service.

Cap on Liability

Our total aggregate liability to you for any claims arising from your use of MySign shall not exceed one hundred pounds (£100).

Exceptions

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence;

  • Fraud or fraudulent misrepresentation; or

  • Any other liability that cannot be excluded or limited by law.

Your Indemnity

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

  • Your breach of these Terms;

  • Your violation of any law or regulation;

  • Your violation of any rights of a third party; or

  • Your provision of false or misleading information.

  1. Changes to these terms

We may modify these Terms at any time.

The current version will always be available at the start of the signing process and on our website.

When you sign a document, you agree to the version of these Terms that is in effect at that time.

Material changes will be notified through the signing interface.

If you do not agree to any changes, you should not proceed with signing any document.

  1. Dispute Resolution

Disputes About Documents

If you have a dispute about the content, validity, or enforceability of a document you have signed, that dispute is between you and the party who sent you the document.

We are not a party to that dispute.

Disputes About the Service

If you have a complaint about the MySign service itself, please contact us first and we will work to resolve the issue informally.

Mediation

If informal resolution is unsuccessful, we may agree to attempt mediation before commencing legal proceedings.

  1. Governing Law and Jurisdiction

These Terms are governed by the law of England and Wales.

The courts of England and Wales have exclusive jurisdiction to resolve any disputes arising from these Terms or your use of the Service.

  1. General

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of MySign to sign documents.

Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be struck out and the remaining provisions shall remain in full force and effect.

Waiver

No failure or delay by us in exercising any right shall constitute a waiver of that right.

Third-Party Rights

No third party has any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.

Force Majeure

We shall not be liable for any failure or delay in providing the Service where such failure or delay results from circumstances beyond our reasonable control.

BY PROCEEDING TO SIGN A DOCUMENT THROUGH MYSIGN, YOU ACKNOWLEDGE THAT:

  • You have read and understood these Signatory Terms and Conditions;

  • You agree to be bound by these Terms;

  • You consent to the identity verification checks described in these Terms, including soft credit checks;

  • Your electronic signature will have the same legal effect as a handwritten signature;

  • You have read and understand the document you are signing;

  • You have the authority to sign the document; and

  • All information you provide is accurate and truthful.

Important Notices

  • Soft credit checks will appear on your credit file but will NOT affect your credit rating.

  • Your electronic signature is legally binding.

  • Read documents carefully before signing.

  • Seek independent advice if you are unsure about any document.

  • Keep copies of signed documents for your records.
